Terms and Conditions of the Affiliate Program

1. Affiliate Agreement

This agreement outlines the terms and conditions for participation in the Dot Cube Affiliate Program. The term “Affiliate” pertains to you (the applicant), and “Dot Cube” refers to Dot Cube (Pty) Ltd., with whom this agreement is established. By applying to the Dot Cube Affiliate Program, you affirm that you have thoroughly reviewed the agreement and consent to the terms and conditions herein.

2. Affiliate Registration

Any Dot Cube client can enrol as an Affiliate. Clients can activate their Affiliate Program status through the Dot Cube Client Area.

Each account is intended for use by a single legal entity (e.g., a company or partnership) or an individual user. Sharing your username and password with others or multiple users on a network is strictly prohibited. You are solely responsible for maintaining the security of any issued usernames and passwords, including those of any Invitees.

Usage of the Program for illegal or unauthorized purposes is prohibited. In utilizing the Program, you must not violate any laws within your jurisdiction, including copyright laws.

3. Affiliate Referral Requirement

As an active affiliate, you are required to:

  • maintain at least one (1) active paid Hosting Package on your account.
  • refer at least one (1) new Hosting Package client to Dot Cube every 6 months.

If you do not fulfil these requirements, your affiliate account will automatically cease to accumulate affiliate credits until such time as the requirements are met.

4. Affiliate Program

Affiliates will receive a 10% commission solely on Hosting Packages. Commissions are earned upon sign-up and renewal of Hosting Packages, whether Monthly or Annually.

5. Commissions

Commissions are generated when a customer completes an order form and submits full payment for any Hosting Package. Only sales resulting from qualified and properly structured Affiliate links will be eligible for commissions. It is the affiliate’s responsibility to ensure correctly coded links. Commission details can be monitored via the Affiliate Dashboard.

Affiliates will continue to accrue commissions on the Hosting Package for as long as the Hosting Package remains active.

Affiliates are responsible for verifying the accurate allocation of commissions to their Affiliate Account, viewable on the Affiliate Dashboard within the Dot Cube Client Area.

6. Payment

An Affiliate can request a payout once their balance reaches a minimum of R200.00. Payment requests can be made as frequently as desired. Payment processing will occur as promptly as feasible. Payments will generally be issued as credits to the Affiliate Account, which can be used to settle outstanding invoices. Credits are non-transferable and cannot be converted to cash.

7. Refunds

If a customer requests a refund for a transaction on which the Affiliate earned commissions, the commissions on the refunded amount will be deducted from the Affiliate’s balance.

8. Usage and Obligations

Affiliates are authorized to use Dot Cube’s branding and marketing resources available in the Affiliate section of the Dot Cube Client Area. Modification of logos and assets is prohibited. Affiliates do not gain rights to these materials, such as trademarks or copyrights.

Affiliates must not suggest that they are representing Dot Cube or directly advertise Dot Cube products. Competing advertisements for Dot Cube products are strictly prohibited.

Affiliates must refrain from presenting themselves, Dot Cube, or their association with Dot Cube in a deceptive or inaccurate manner.

Distribution of unsolicited bulk emails (spam) referencing Dot Cube is prohibited.

9. Term and Termination

Either party reserves the right to terminate this agreement without prior notice.

Upon Affiliate-initiated termination, no further commissions from Dot Cube will be paid for past or future customer transactions.

In the event of Dot Cube’s termination, a balance exceeding R200.00 will be paid to the affiliate within 7 days. Balances below R200.00 will be forfeited.

Dot Cube will not be liable for future payments post-termination.

10. Governing Law

The interpretation and enforcement of this Agreement shall be governed according to the laws of the Republic of South Africa (excluding its choice of law rules). By agreeing to this Agreement, the client consents to personal jurisdiction in the federal and provincial courts of South Africa for any action arising from the use of Dot Cube services. The prevailing party in any such action is entitled to recover all legal expenses, including costs and reasonable attorney’s fees. This Section’s terms will survive termination.

11. Arbitration

Parties aim to resolve disputes amicably. Unresolved disputes will be subject to binding arbitration upon the written demand of either party. Arbitration will take place in South Africa. Legal action to enforce this Agreement, including the right to collect unpaid invoice amounts, may lead to the prevailing party recovering attorney’s fees and expenses at trial and appellate levels. This Section’s terms will survive termination.

12. Modification

We retain the right to modify any terms and conditions in this Agreement at our discretion. Modifications may encompass changes to available commissions, commission schedules, payment procedures, and Affiliate Program regulations.
